These Terms and Conditions details the licence Webskape Ltd (“Webskape”) grants Users. It also governs the Users use of Webskape’s Educational Resources, including but not limited to Emile, Learn with Emile, and Fun Maths Games with Emile.

By using the Educational Resources, Users are agreeing to the terms that appear below.

Contracting Party
Your subscription contract will be fulfilled by Webskape Ltd, a company registered in England and Wales whose registered office is at Green Rake House, Birtle, Bury, Lancashire, BL9 6TR.

General

Users’ access to and use of Educational Resources is conditional on their acceptance and compliance with the terms, conditions, notices and disclaimers contained within these
Terms & Conditions

User’s access to and use of Educational Resources constitutes their agreement to be bound by the Terms & Conditions. If you do not agree to any of the Terms & Conditions, you must immediately cease using Educational Resources.

We reserve the right to revise and update the Terms & Conditions at any time effective on the date of publication. 

When the subscription contract is formed
When you fax, post, email or telephone us with details of an order, you are making an offer to take out a subscription which if accepted by us, will result in a binding contract.

Right to refuse orders
We reserve the right not to accept an order.

Subscriptions 
In order to access and use Educational Resources, all Users must have a valid subscription or trial. All access and use of Educational Resources is strictly limited to the User’s subscription period (or where applicable, trial period).

Subscriptions are not transferable.

We reserve the right to temporarily suspend and/or cancel unpaid subscriptions.

Renewals

The subscription will automatically renew for a further 12 month period at the previous price unless notice is given in writing that the subscriber wishes to stop the service prior to the commencement of the further 12 month period.

Cancellations and Refunds
Subscriptions can be purchased for multiples of 12 month periods.

Cancellations are not permitted until the end of a purchased period and no refund will be issued.

Third Party Rights

A person who is not a party to these Terms and Conditions shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce or rely upon any provision of them.

Content
The materials contained in the Educational Resources, including without limitation all text, graphics, videos, names, logos and trade marks protected by copyright, trade mark and other intellectual property laws unless otherwise indicated.

Users must not modify, copy, reproduce, republish, frame, download onto a computer, upload to a third party, post, transmit, share or distribute this Content in any way except as expressly provided for in these Terms & Conditions or with our express prior written consent

Users must not use the Content for commercial purposes without first obtaining our prior written consent.

Disclaimers and Limits of Liability
Although we have no reason to believe that any information contained within Educational Resources is inaccurate, we do not warrant the accuracy, adequacy or completeness of the information, nor do we undertake to keep the Educational Resources updated.
